Favoriser la collaboration professionnelle avec les proches aidants : la nécessité d’établir un cadre juridique pour préciser leurs droits, leurs obligations et leur responsabilité civile

La détermination du congé hospitalier d’une personne vulnérable nécessite une collaboration étroite avec les proches aidants. Or ceux-ci se retrouvent souvent à assumer une grande part de responsabilité concernant l’assistance à fournir une fois de retour à domicile, sans qu’ils n’aient formellement consenti ni reçu une formation adéquate pour prodiguer de tels soins. Cette situation a des effets délétères sur la santé des proches aidants. Une analyse du cadre juridique québécois concernant les proches aidants révèle que ce dernier est insuffisant pour les protéger adéquatement. Cet essai vise à soulever des solutions novatrices à ce constat, soit la création d’une loi particulière précisant le statut de proche aidant et l’établissement d’un cadre juridique précisant leurs droits, leurs obligations et les éléments de leur responsabilité civile notamment en cas de faute commise par le proche aidant dans le cadre de son rôle.
Abstract
When a vulnerable person is discharged from hospital, there should be a close collaboration between the medical staff and the caregivers who will be looking after that person upon their release. Caregivers often find themselves having to take on greater responsibilities when their patients return home, yet they do so without having provided formal consent and without adequate training. This situation has deleterious effects on the caregivers’ health. An analysis of Quebec’s legal framework for caregivers reveals that they are not adequately protected. This article identifies some innovative solutions, including the creation of legislation recognizing the status of caregivers and establishing a legal framework that outlines their rights, obligations and civil liability (most notably in the case of malpractice by the caregiver).
